Terms of Service

These terms govern your use of Fictate (the “app”), operated by RockHaven Partners LLC DBA FictionCourses.com (“we,” “us”). By creating an account or using the app, you agree to these terms.

Your account

You’re responsible for keeping your login secure and for activity under your account. You must be old enough to form a binding contract in your country to use the app.

A Fictate account is for one author. Please don’t share your login, or your account’s dictation hours, with anyone else — including co-writers, assistants, or writing group members. Each author needs their own account. We may suspend accounts showing use consistent with sharing.

Your content is yours

You own everything you create with Fictate — your recordings, transcripts, dictionary, and outlines. We claim no ownership of your work. We process your content only to provide the service (see our Privacy Policy), including sending audio and text to our processing providers to transcribe and clean it up.

Your transcript text is kept for as long as your account exists, on every plan. Audio recordings are kept for 90 days, after which the audio file is removed and the transcript remains. You can download your audio at any time within that window.

Acceptable use

Use Fictate for your own lawful writing and dictation. Don’t use it to break the law, infringe others’ rights, or abuse, overload, or reverse-engineer the service. We may suspend accounts that do.

Subscriptions and billing

Some features require a paid plan. New subscribers may be offered a 7-day free trial on a monthly plan. Unless you cancel before the trial ends, it converts automatically into a paid subscription at that plan’s regular price. One free trial is available per customer.

Paid plans renew automatically until cancelled, and access continues through the end of the current billing period.

If you subscribe through the iPhone or Android app, billing is handled by the Apple App Store or Google Play. You can cancel anytime in your App Store or Google Play account settings, and store purchases are governed by that store’s refund policies.

If you subscribe on the web at app.fictateapp.com, our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for these orders: they handle billing, applicable taxes, and payment questions. You can cancel a web subscription anytime from Account & Settings or by emailing support@fictioncourses.com. Refunds for web purchases are available within 14 days of purchase: request one from us at support@fictioncourses.com or from Paddle’s buyer support at paddle.net, and Paddle will process it in accordance with Paddle’s Refund Policy. If a purchase isn’t right, tell us — we’ll make it right.

Service availability

We work to keep Fictate reliable, but the app is provided “as is,” without warranties of any kind. We don’t guarantee uninterrupted or error-free service, and transcription accuracy can vary. Keep your own backups of work that matters to you.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Changes

We may update these terms or the app over time. When we make material changes, we’ll update the “Last updated” date above. Continued use after changes means you accept the updated terms.
